This focuses too much on means and not enough on ends. It would more useful to recognize that the core of what they (and you) are arguing is “people shouldn’t get in trouble for saying that” not “ok, yes, people should get in trouble for saying that, but not in that way.”

I’m trying to push the debate in that direction, because when participants avoid what they’re actually talking about and discuss abstract principle instead, they talk past each other.
