I think that’s a big part of it, yes. As I said in the article, “Ideally, issues such as abortion and same sex marriage would be decided in the legislature, rather than shunted off to the courts, but it’d be very difficult to get that toothpaste back in the tube.” Similar argument applies to other issues too.
